What rights does a father have?


The first right a father has is to know the truth. He has invested his heart and soul and spirit into a relationship. Betrayal, deceit and lies not only destroy him as a person but place an enormous financial burden on him unjustly. How can he happily and willing support, love, cherish and care for a child conceived without his knowledge? Not only is this a crushing blow to the father, the child is left with a feeling and life experience as an unloved orphan.

A father has a right to establish a loving relationship with his children. He has a right to visitation and quality time to bond, teach and encourage his children to grow into responsible adults. A father has a right to give his children his love, affection, training and care to bring them up to rightfully and honorably receive his inheritance.

The relationship between a father and his children is established in three legally recognized arenas: custody, child support and visitation. These are the matters of conflict regarding the children.

All of this reflects on the best interest of the minor children to receive the love, affection, training and care for their mental, emotional, physical, financial and spiritual well being and growth – not just one.
Legally:
Best Interest argument is the willingness and ability of each parent to facilitate and encourage a close and continuing relationship between the other parent and the child. The court shall presume that the maximum involvement and cooperation of both parents regarding the physical, mental, moral and emotional well-being of their child is in the best interest of the child.

Why you need a DNA Test


A DNA test is the evidence presented to the court to support your testimony, argument and requests to the court. Many states have already passed legislation that provides for courts to accept and consider DNA paternity testing in making a decision.

What legal documentation is required for the courts?


Each county and court have specific documents to complete and file to bring a case before the court known as setting a hearing date. The hearing date is scheduled when the documents are approved and filed with the clerk of the court.
